The box colour may be selected from the available options. The exact contents are a surprise; product images are examples and may differ from the delivered contents. Where a particular artwork or pendant requires specific material or safety information, that information is provided on the item, on its packaging or in an enclosed notice.

Safety information: Art and collectable product, not a toy and not intended for consumption. Individual boxes may contain a small handmade pendant, which may have small or detachable components. Keep such small parts away from children under 3 years of age – choking hazard if swallowed. Check the fastening before using the pendant; do not continue to use damaged or loose components and keep them out of children's reach. Observe any additional information enclosed with an artwork or pendant.

1. Seller, scope and contract language

These Terms apply to consumer orders from Johannes Fröhlich, trading as wunstkunst♥, Wilhelmstr. 48, 10117 Berlin, Germany. Contracts may be concluded in German or English. The language selected when the non-binding request is submitted applies.

2. Product and quantity

Each Wunstkunst box contains six small painted, printed or written artworks by changing artists and may occasionally include a small handmade pendant. The exact contents are a surprise and product images are examples. The box colour may be selected from the available options. Online requests are limited to 100 boxes.

3. Non-binding request, corrections and formation of contract

Select the quantities by colour and the destination country. The goods value, number of shipments, shipping charge and total price are displayed before submission. All entries can be corrected in the form and with the quantity controls before submission.

Clicking “send non-binding order request” submits a non-binding enquiry only. No purchase contract or payment obligation arises. The automatic email sent immediately afterwards only confirms receipt and includes the request summary, payment information, these Terms and the withdrawal information.

Only if the customer then voluntarily pays the total shown in that email by bank transfer or PayPal does the customer make a binding offer to purchase on the terms summarised in the email. A contract is formed when we accept that offer within five working days after receipt of payment, either expressly by email or by dispatching the goods within that period. If we do not accept the offer within that period, we will refund any payment received without undue delay.

Request and payment data are stored for the periods explained in the privacy policy and required by law. No customer account is created. The confirmation email can be saved and printed.

4. Prices

The final price is €10.00 per box. VAT is not shown under section 19 of the German VAT Act (UStG). Only the shipping charges displayed before the request is submitted are added.

5. Shipping charges and destinations

A maximum of eight boxes is packed per shipment. The number of shipments is rounded up from the total quantity. Each shipment costs €2.70 within Germany and €6.99 to other EU countries selectable in the form.

6. Delivery time

After payment and acceptance of the purchase offer, goods are normally dispatched within five working days. Where acceptance takes place by dispatch, dispatch itself constitutes acceptance. Normal transit is approximately two to five working days within Germany and five to fourteen working days to other EU countries. We will email you about larger orders or unforeseen delays.

7. Payment

Bank-transfer and PayPal details are provided only in the automatic email confirming the non-binding request. No payment is due merely because the request was sent. Payment is voluntary and constitutes the customer’s binding purchase offer. The reference stated in the email should be used so that the payment can be matched. No goods are dispatched without payment and acceptance.

8. Retention of title

Goods remain our property until paid in full.

9. Statutory conformity rights

Statutory consumer conformity and warranty rights apply. Minor differences in colour, texture and execution are characteristic of handmade art products and are not defects unless the agreed qualities or normal use are impaired.

10. Right of withdrawal

Submitting the non-binding request does not form a contract. Once a distance contract has been formed after payment and acceptance, consumers have the statutory right of withdrawal described below. The withdrawal period does not begin with the request or payment alone, but after formation of the contract when the goods are received, or when the last goods are received if one order is delivered in several shipments. The consumer bears the direct costs of returning the goods.

11. Liability

Liability is unlimited for intent, gross negligence, injury to life, body or health and where mandatory law requires. For slight negligence affecting an essential contractual duty, liability is limited to foreseeable typical loss. Liability for other slight negligence is excluded.

12. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection under the law of their habitual residence. Statutory consumer venues apply.

13. Complaints and dispute resolution

Complaints may be sent to sale@wunstkunst.de. We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration body.

Withdrawal information

Note on the request process: submitting the non-binding order request does not form a contract. The following information applies once a contract has been formed after voluntary payment and our acceptance.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, takes possession of the goods. Where a contract covers several goods ordered in one order and delivered separately, the period starts on the day on which you, or a third party named by you who is not the carrier, takes possession of the last goods.

To exercise the right of withdrawal, inform us – Johannes Fröhlich, wunstkunst♥, Wilhelmstr. 48, 10117 Berlin, Germany, email sale@wunstkunst.de – by an unequivocal statement, for example a letter sent by post or an email, of your decision to withdraw from this contract. You may use the model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs – except for supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us – without undue delay and no later than fourteen days after the day on which we receive your withdrawal statement.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or hand over the goods to Johannes Fröhlich, wunstkunst♥, Wilhelmstr. 48, 10117 Berlin, Germany, without undue delay and in any event no later than fourteen days after the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period has expired. You bear the direct costs of returning the goods.

You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

1. Controller

2. Website access

When the website is accessed, the web server processes technically necessary connection data, particularly the IP address, date and time, requested file, transferred data volume, referrer and browser or system information. Processing supports secure and stable operation under Article 6(1)(f) GDPR. Logs are retained only for as long as required for operation, error analysis and security, and are then deleted or anonymised unless a security incident or legal obligation requires longer retention.

3. Non-binding order request and contract

For a non-binding order request, we process your name, delivery address, email address, selected quantities and colours, destination country, notes, calculated goods and shipping value and a request reference. The purposes are to process the pre-contractual enquiry, send the summary and payment details and – if a voluntary payment follows – decide whether to accept and perform the contract. The legal basis is Article 6(1)(b) GDPR.

Where a payment is made, we additionally process payment information required for matching, acceptance, accounting, refunds and evidence, such as the payer’s name, amount, date, reference and transaction details received from the bank or PayPal. Payment through PayPal or a bank is initiated by the customer outside this website; the privacy information of the selected payment provider also applies.

4. Other contact requests

For other contact requests, we process the contact details and content supplied in order to deal with the request. Depending on the subject, the legal basis is Article 6(1)(b) or (f) GDPR.

5. Recipients and service providers

Data are disclosed only where needed for operation, communication, payment handling or contract performance. Recipients may in particular include the hosting and email provider, banks or PayPal and, after formation of a contract, the selected carrier. An internal copy of each order request is also sent to a Gmail mailbox. Order data are not disclosed for advertising.

6. Gmail and possible third-country processing

Gmail is used for the internal email copy. The provider for users in the European Economic Area is generally Google Ireland Limited; processing by Google LLC or other Google companies outside the European Economic Area, particularly in the United States, cannot be excluded. Where a third-country transfer occurs, it is based on an applicable adequacy decision or appropriate safeguards such as standard contractual clauses. Information about the safeguards used in a particular case may be requested from sale@wunstkunst.de.

7. Retention

Non-binding requests that do not lead to a contract are deleted once it is clear that no contract will be formed and no legal or legitimate reason requires continued storage. If a contract is formed, contract, payment and accounting records are retained for the applicable commercial and tax periods and, where relevant, until applicable limitation periods expire. Security logs and simple contact enquiries are retained only for as long as required for their purpose.

8. Cookies, analytics and external content

At present, this website uses no non-essential cookies, audience analytics or automatically embedded social-media or music players. External providers are contacted only when you click an external link; their privacy information then applies.

9. Your rights

Subject to the statutory conditions, you have rights of access, rectification, erasure, restriction of processing and data portability. You may object to processing based on legitimate interests for reasons arising from your particular situation. Consent may be withdrawn at any time with effect for the future.

10. Right to complain

You may lodge a complaint with a data-protection supervisory authority, in particular the authority for your place of residence or the authority responsible for Berlin.

11. Required data and automated decisions

Fields marked as required are necessary to process the request and, where applicable, perform a contract. The request cannot be processed without them. We do not use automated decision-making or profiling.
